Unmarried mothers rights refer to the primary or natural custodial rights of children born when she is not married. 
This legal right extends to the custody, care, and control over the child. An unmarried mother has rights that are superior to those of the father or any other person.  However these rights can be withdrawn by the court if it can be proved in a court of law that the mother is unfit or has abandoned the child.

Unmarried Mothers Rights to Her Child

However unless the court has stated otherwise, an unmarried mothers rights to her child are complete and total, unless she is a minor. She need not show an order for custody of the child. A copy of the birth certificate and the mother’s ID proof is all that is needed. She has the legal guardianship and custody of the child. It pertains to the mother’s decisions about the child’s medical care, religious upbringing, education, and extracurricular activities along with decisions about the visitation rights of the father. She has a right to act on her child’s behalf in legal proceedings and may deal with the child’s property.

In addition to this, unmarried mothers rights extend to support services as well. If the unmarried mother finds the biological father not willing to support her, then she can request assistance from Child Support Services. The unwed mother can get support for her child by contacting a child support officer and putting the support services for her child in order. In addition a woman can file a paternity claim on the biological father who has not claimed paternity and ask for child support. If an order has been passed that obligates a man to pay child support and he does not do it, then the court may take action against the father.

In cases where the biological father or any other person refuses to return a child born out of the wedlock, then it amounts to serious criminal offense which is punishable in the court of law. Taking the child out of state, hiding the child or refusing to return the child may amount to 1 to 6 years in prison, $3,000 fine. Contact a legal officer or law enforcement in such a case.

Unmarried Mothers Custody Rights

The unmarried mothers custody rights may be contested in a court of law. An unmarried father may want custody of the child. This is dependent on the suitability of the biological father. Moreover full custodial rights are hardly ever awarded to unwed fathers unless the mother is not financially capable or unfit to support the child. However visitation rights may be awarded to the father. However this is subject to the court’s decision regarding the best interests of the child. If the biological father has visitation rights but does not pay child support even when ordered by the court, the mother has no right to deny the visitations. These are two separate matters and you need to approach the court of law to file a case against denial of proper and timely child support for your child.
